Former Gotham member Laura Willis has a pressing problem regarding her mother – in – law who is on Medicaid.  Please see below – her mother in law currently lives in supportive housing, but Laura and her husband need to move her closer to them.

Hey Susan!  I have a question in relation to Medicaid, NYC co-op apartments, and rent. My mother-in-law lives in nonprofit supportive housing where she pays a percentage of her income, which is solely Social Security (so it's a few hundred a month), she is already on Medicaid and receives SNAP benefits. Unfortunately, she is a 45-minute drive from us in Westchester, the house has stairs, and her mobility is declining rapidly. My husband and I recently sold his old bachelor pad and have money to purchase a studio co-op apartment within walking distance of our Bronx co-op. We have identified a building whose board allows relatives of the shareholders to be the tenant and shareholder occupancy is not required. We would pay 100% cash for the purchase and pay the maintenance as well.

Our big question is, will Medicaid require us to charge her rent? Are there other potential implications for her, or for us financially that we have not thought out here? Do I need an eldercare lawyer to figure this out, and is there someone you would recommend? I wasn't sure if Gideon Schein would handle this type of matter.

We were planning on making an offer on a place tomorrow afternoon, but were worried about going into contract and then finding out this would be complicated. The attorney who handled our recent sale (and the sale of the co-op we live in 8 years ago) has only dealt with people who wanted to get on Medicaid and are divesting assets, not someone who is on it already.

This may not be within your wheelhouse at all, but you are one the smartest ladies I know and I wanted to say hello!
