[Fredslist] A legal question involving former employees

Former employer is in a civil suit with their former managing director that
is also a board member of the company.
Two employees reported to the two people who are suing and counter-suing
each other basically for control of the business. The two employees had
nothing to do with the problem just caught in the middle for a while. One
employee voluntarily departed the company 4 years later in Nov 2015.
The suit is now moving to depositions. The former employee was subpoenaed
to appear for the deposition. The employee now works for another company.
Can she avoid the subpoena since she is no longer part of the old company?
What is the former employee's obligation? Can the new employer be
compensated for the loss of the employee if the subpoena can not be avoided?
