Dear Gotham Immigration and Tax Attorneys:

A question about a lapsed green card:

My client is a Japanese citizen who purchased a coop apartment in Manhattan in 1988 and subsequently, in 1990, got a green card through a lottery.

Since returning to Japan, she applied for and received two re-entry permits; the last one was 1994-1996.  She hasn't been in the US since, nor has she thought much about her green card since then - not realizing that it would lapse.

Meantime, she's been renting her New York City co-op apartment - and paying tax on the rental income -- and now is selling it*.    It therefore is unlikely that she'll come back to the U.S. in the foreseeable future.

Her U.S. accountant had been filing her U.S. and NY State and City taxes as a resident alien, not realizing that her status has lapsed.

Aside from filing her 2014 taxes as a non-resident, and withholding FIRPTA taxes from the sale, is there anything else my client should do with her regard to her immigration status?
