[Fredslist] WORKERS COMPENSATION PENALTIES

OK - let's see what the Fred's List community can do on this question . . .

I have noticed a significant increase in the number of inquiries and
penalties being issued by the NY Workers Compensation Board, for employers'
failure to maintain workers compensation insurance.  While this is
frequently a result of a computer failure to match-up records, it sometimes
turns out that no coverage is in force.

I am working now with a relatively new client who has received such a
notice, and it looks like the firm has not had coverage in force for the
past year or two.  We've placed coverage, but now the client can expect to
receive a penalty notice for the uninsured period, which runs $250 every 10
days.  Obviously, this is going to be a substantial penalty.

Does anyone have any experience in how best to approach this with the WC
Board?  Will they negotiate the penalty?  

Any guidance in this regard will really be appreciated!
